Before you proceed with your purchase, please read the Store Terms and Conditions, where you will find information including how to place an order and conclude an agreement, delivery methods, the procedure for withdrawing from the agreement, and the complaints process.

The HRM Institute Team

I. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:

Buyer – a natural person with full legal capacity, a legal person, or an organisational unit without legal personality.
Registered Customer – a person who has an account in the Store.
Consumer – a natural person entering into an agreement with the Seller that is not directly related to their business or professional activity.
Terms and Conditions – these Terms and Conditions, available at https://ebeaawards.com/regulamin-sklepu/.
Store – the online store operating at https://ebeaawards.com/en/shop/
Seller – HRM Institute Sp. z o.o., with its registered office in Kraków (30-701), ul. Zabłocie 19A/57, NIP 6793229610, KRS 0000942365.
EB Summit Conference – the Employer Branding Summit conference organised by the Seller in an in-person format. Current dates and locations of the Conference are provided on the websites www.employerbrandingsummit.pl and www.ebeaawards.com.
EBEA Competition – the Employer Branding Excellence Awards competition organised by the Seller. Current dates, competition categories, and participation rules are provided on the website www.ebeaawards.com.
EBEA Competition Entry – the purchase of participation in the EBEA Competition, consisting of the Participant submitting an entry in the selected competition category.
Physical Products – books available in the Store, in particular Employer Branding bez tajemnic, and other items from the Seller’s offer.
Digital Products (e-books) – electronic versions of publications and other digital content available in the Store.

II. Preliminary Provisions

  • Through the Store, the Seller enables the Buyer to: conclude a sales agreement for physical products, including printed books; purchase digital products, including e-books; purchase tickets entitling the Buyer to participate in the EB Summit Conference; purchase a competition entry for the EBEA Competition; and purchase other electronic products available in the Store, such as online training courses, webinars, audio and video recordings, worksheets, printable files, and others.
  • These Terms and Conditions define the rules and conditions for using the Store, as well as the rights and obligations of the Seller and Buyers.
  • No special technical requirements need to be met by the Buyer in order to make purchases in the Store. Access to the Internet, a standard operating system, a standard web browser, and an active email address are sufficient.
  • If the use of digital content requires additional technical requirements to be met, such requirements are indicated in the description of the digital content in the Store.
  • The Buyer may not make purchases in the Store anonymously or under a pseudonym.
  • The Buyer is prohibited from providing unlawful content, in particular by submitting such content via forms available in the Store.
  • All product prices displayed on the Store pages are net prices, to which VAT will be added at the applicable rate.

III. Services Provided Electronically

  • Through the Store, the Seller provides electronic services to the Buyer.
  • The basic electronic service is enabling the Buyer to place an order in the Store. Placing an order does not require creating an account in the Store.
  • If the Buyer decides to subscribe to the newsletter, the Seller also provides a service consisting of sending email messages containing information about news, promotions, products, or services. The Buyer may unsubscribe from the newsletter at any time by clicking the unsubscribe button in each message or by sending an appropriate request to the Seller. The services are provided electronically free of charge.
  • Sales agreements and agreements for the supply of digital content concluded through the Store are paid or free of charge, depending on the type of product.
  • The Seller applies technical and organisational measures appropriate to the level of risk to the security of the services provided, in particular measures aimed at preventing unauthorised persons from obtaining and modifying personal data.
  • Any complaints related to the functioning of the Store may be submitted by the Buyer to the following email address: biuro@hrminstitute.pl. When submitting a complaint, the Buyer should provide their first name and surname, correspondence address, as well as the type and date of the irregularity. The Seller reviews complaints within 14 calendar days of receiving them.

IV. Physical Products

  • Orders for physical products are fulfilled by shipping the purchased products to the address indicated by the Buyer.
  • The Buyer may choose the delivery method: delivery to a parcel locker or courier delivery to the indicated address (for a fee). The order may also be collected in person in Kraków, at ul. Zabłocie 19A/57, by prior arrangement with the Seller (free of charge).
  • The order fulfilment time should not exceed two business days, unless otherwise stated in the product description in the Store. Pre-order products may have a future fulfilment date indicated.
  • The order is considered fulfilled once the shipment has been dispatched to the Buyer.
  • The shipment will be delivered to the Buyer within the timeframe resulting from the delivery method selected by the Buyer.

V.  Intellectual Property Rights

  • The Seller informs the Buyer that the content available on the Store’s website and the digital content sold through the Store may constitute works within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, to which the Seller holds the copyrights.
  • Any further distribution by the Buyer of content protected by copyright without the Seller’s consent, except for use within the scope of permitted personal use, constitutes an infringement of copyright and may result in civil or criminal liability.

VI. Placing an Order

  • The Buyer may place an order as a Registered Customer or without creating an account in the Store.
  • An order is placed by completing the order form after previously adding the selected products to the cart. Acceptance of the Terms and Conditions is required in order to place an order.
  • Depending on the subject of the order, the appropriate type of agreement is concluded between the Buyer and the Seller: in the case of physical products – a sales agreement; in the case of digital products – an agreement for the supply of digital content; in the case of tickets for the EB Summit Conference or EBEA competition entries – a service agreement.
  • If the order includes different types of products at the same time, placing the order results in the conclusion of several agreements corresponding to the subject of the order.
  • If, when placing the order, the Buyer selected online payment, after confirming the order they will be redirected to the payment gateway operated by the payment provider. In the case of payment by bank transfer, the order should be paid for within 3 business days from the conclusion of the agreement.
  • The Buyer must provide true personal data. The Seller reserves the right to suspend order fulfilment if the data gives rise to reasonable doubts as to its accuracy.

VII. Payment

  • The available payment methods are described on the Store pages and presented to the Buyer at the order placement stage.
  • The electronic payment operator is PayPro S.A. Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, NIP 779-236-98-87, KRS 0000347935.
  • If the Buyer has requested an invoice, it will be delivered electronically to the email address provided in the order form.
  • Individual payment terms may be applied – for this purpose, prior arrangement with the Seller by email or telephone is required.

VIII. Performance of the Agreement

  • Fulfilment of an order including electronic products (e-books, online training courses, recordings, webinars, and other digital content) takes place by sending a message to the Buyer’s email address containing instructions for downloading or accessing the purchased content.
  • In the case of online courses, an account will be created for the Buyer on the online course platform, and access details will be sent by email.
  • Access to the content included in an online course may be time-limited in accordance with the information provided in the course description in the Store.
  • The Buyer is required to use the course platform in a manner compliant with the law and the Terms and Conditions, and in particular: not to share access details with third parties, not to distribute course content without the Seller’s prior consent, and not to use malicious software.
  • Fulfilment of an order including physical products takes place by shipping the purchased products to the address provided by the Buyer. The order is considered fulfilled once the shipment has been dispatched.

IX. Participation in the EB Summit Conference
Registration

  • Registration for the EB Summit Conference takes place by adding the selected ticket to the cart and completing the order form.
  • If the Buyer has selected online payment, after confirming the order they will be redirected to the payment gateway. In the case of payment by bank transfer, the order should be paid within 7 calendar days from the conclusion of the agreement, unless another deadline has been agreed.
  • In cases where the rules applicable in the Participant’s company do not allow registration via the online form, registration is possible using a registration form sent upon request to: biuro@hrminstitute.pl.
  • Sending the form available on the Store website or returning the completed form by email constitutes acceptance of these Terms and Conditions.
  • If registration is made by a person other than the Participant, that person is responsible for the accuracy of the information provided and should be authorised by the Participant to provide their personal data. The Participant’s details (first name, surname, email address, and phone number) should be entered in the Comments field.
  • By submitting the form, the Participant/Ordering Party consents to the sending and receipt of the pro forma invoice and VAT invoice electronically to the email address indicated in the order.

Participation Fee for the EB Summit Conference

  •  The current participation fee for the Conference is available at https://ebeaawards.com/en/registration/. The fee includes participation for one person, or more people according to the product description, conference materials, lunch, and coffee breaks.
  • Available payment methods: traditional bank transfer and electronic payment, including card, BLIK, fast online transfers, etc.

Cancellation of Participation in the EB Summit Conference

  • The Ordering Party may cancel participation in the EB Summit Conference by sending a cancellation statement to the email address biuro@hrminstitute.pl.
  • Cancellation is possible only at least 14 calendar days before the date of the Conference. In such a case, the Organiser will refund the fee paid in full.
  • Cancellation submitted later than 14 calendar days before the date of the Conference does not entitle the participant to a refund of the fee. Instead of cancelling, it is possible to indicate another person who will participate in the Conference in place of the cancelling Participant.
  • Notwithstanding the above, a Participant/Buyer who is a consumer may withdraw from the agreement without giving any reason within 14 calendar days of its conclusion, in accordance with the provisions of the Consumer Rights Act – subject to the reservation that this right does not apply to agreements concluded less than 14 calendar days before the date of the Conference.
  • If the Participant is unable to attend the Conference, participation in another event organised by the Organiser is possible, subject to prior agreement. If the price of that event is higher, the Participant is required to pay the difference.
  • Failure to cancel the registration and failure to attend the Conference will result in the Ordering Party being charged the full costs, without the possibility of crediting them towards participation in another event.
  • Participation in the Conference is conditional upon payment of all fees, unless individual payment terms have been agreed with the Organiser.

Changes to the EB Summit Conference Programme

  • The Organiser reserves the right to change the Conference programme, including speakers, topics, and presentation times, as well as the date and venue of the Conference.
  • The Organiser informs Participants/Ordering Parties of changes to the programme via the website and by email.
  • The Organiser reserves the right to cancel the Conference up to the day preceding its commencement. Notice of cancellation is sent to the email address provided in the registration form.
  • In the event of cancellation of the Conference, the Organiser will refund the fee paid to the bank account from which the payment was made within 7 business days of sending the cancellation notice.

X. Entries for the EBEA Competition
Registration of an Entry

  • A competition entry for the EBEA Competition is submitted by adding the selected competition category to the cart and completing the order form. The current list of categories and price list are available at www.ebeaawards.com.
  • If the Buyer has selected online payment, after confirming the order they will be redirected to the payment gateway. In the case of payment by bank transfer, the order should be paid within 7 calendar days from the conclusion of the agreement, unless another deadline has been agreed.
  • Sending the order form constitutes acceptance of these Terms and Conditions.
  • By placing an order, the Buyer/Participant consents to the sending and receipt of the pro forma invoice and VAT invoice electronically to the email address indicated in the order.

EBEA Competition Fee

  • The current competition fee is published at www.ebeaawards.com. Different pricing tiers may be available, including Early Bird, Regular, and Late, with their validity periods specified on the Competition website.
  • Available payment methods: traditional bank transfer and electronic payment, including card, BLIK, fast online transfers, etc.

Cancellation of an EBEA Competition Entry

  • The Ordering Party may cancel the competition entry by sending a cancellation statement to the email address biuro@hrminstitute.pl.
  • Cancellation is possible only at least 14 calendar days before the announced deadline for accepting entries. In such a case, the Organiser will refund the fee paid in full.
  • Cancellation submitted later than 14 calendar days before the deadline for accepting entries does not entitle the Ordering Party to a refund of the fee.
  • Notwithstanding the above, a Buyer who is a consumer may withdraw from the agreement without giving any reason within 14 calendar days of its conclusion, in accordance with the provisions of the Consumer Rights Act – subject to the reservation that this right does not apply to agreements concluded less than 14 calendar days before the deadline for accepting entries.
  • Failure to cancel the entry and failure to submit competition materials will result in the Ordering Party being charged the full entry fee.

Changes to the EBEA Competition

  • The Organiser reserves the right to change the Competition schedule, including deadlines, categories, and evaluation rules.
  • The Organiser informs Participants of any changes via www.ebeaawards.com and by email.
  • In the event of cancellation of the Competition, the Organiser will refund the fees paid within 14 calendar days of sending the cancellation notice.

XI. Withdrawal from the Agreement by the Consumer

  • A Consumer who has concluded a distance agreement with the Seller has the right to withdraw from the agreement without giving any reason within 14 calendar days from the date of taking possession of the purchased items (sales agreement for physical products), or within 14 calendar days from the date of conclusion of the agreement (agreement for the supply of digital content or service agreement).
  • The right to withdraw from the agreement under the terms described in this section also applies to a natural person concluding an agreement with the Seller directly related to their business activity, where the content of the agreement indicates that it is not of a professional nature for that person.
  • The right to withdraw from the agreement does not apply to agreements for the supply of digital content not supplied on a tangible medium, if the performance of the service began with the Consumer’s express consent before the expiry of the withdrawal period and after the Consumer had been informed of the loss of the right of withdrawal.
  • The right to withdraw from an agreement concerning participation in the EB Summit Conference or an EBEA competition entry does not apply if there are fewer than 14 calendar days between the conclusion of the agreement and the date of the Conference or the deadline for accepting competition entries.
  • To withdraw from the agreement, the Consumer must inform the Seller of their decision by means of an unequivocal statement – by post or by email to biuro@hrminstitute.pl.
  • The Consumer is required to return the product to the Seller immediately, no later than 14 calendar days from the date of withdrawal from the agreement. The Consumer bears the cost of return.
  • In the event of withdrawal from the agreement, the Seller will refund all payments received from the Consumer immediately, no later than 14 calendar days from the date of being informed of the withdrawal.
  • The Consumer is liable for any reduction in the value of the product resulting from using it in a manner exceeding what is necessary to establish its nature, characteristics, and functioning.

XII. Liability for Defects

  • The Seller is obliged to provide the Buyer with a product and digital content free from defects.
  • The Seller is liable to the Buyer for physical or legal defects of the sold product or digital content (statutory warranty for defects).
  • If the Buyer identifies a defect, they should inform the Seller, specifying their claim or submitting an appropriate statement.
  • The Seller will respond to the complaint within 14 calendar days from the date of its delivery.

XIII. Personal Data and Cookies

  • The Seller is the controller of the Buyer’s personal data.
  • The Buyer’s personal data is processed for the purpose of handling orders and for the possible defence, pursuit, or establishment of claims related to the agreements concluded.
  • The Store uses cookies technology. Details regarding the processing of personal data and cookies are available in the Privacy Policy at https://ebeaawards.com/polityka-prywatnosci/.

XIV. Out-of-Court Complaint Handling and Claim Resolution

  • The Seller agrees to submit any disputes arising from concluded agreements to mediation proceedings. The details will be determined by the parties to the dispute.
  • The Consumer may use out-of-court methods of complaint handling and claim resolution, including: applying to a permanent consumer arbitration court, using the assistance of the provincial inspector of the Trade Inspection Authority, or the district consumer rights ombudsman.   • The Consumer may also use the ODR platform available at: http://ec.europa.eu/consumers/odr.

XV. Final Provisions

  • The Seller reserves the right to introduce and withdraw offers and promotions, as well as to change prices in the Store, without prejudice to the rights acquired by the Buyer.
  • Any disputes related to agreements concluded through the Store will be heard by the Polish common court having jurisdiction over the place where the Seller permanently conducts its business activity. This provision does not apply to Consumers or natural persons concluding an agreement not related to their professional activity – in such cases, court jurisdiction is determined according to general rules.
  • The Seller reserves the right to amend the Terms and Conditions. Agreements concluded before the amendment of the Terms and Conditions shall be governed by the Terms and Conditions in force on the date of conclusion of the agreement.
